Child support

My exhusband agreed to pay maintance in the amount of 10% of his income so I could work part time and do my daughters treatments, doctors appointments, etc. We filed the paperwork with the courts 3 years ago. Now he has a new girlfriend and wants to take me to court and get it off. I feel this is unfair as he has missed so many appointments, and was able to pursue his career as I worked part time. I also do not want to start working full time and compromise my daughters care. Has anyone gone through the legal process? Do judges take into consideration the special needs of the kids? Maya also has a heart defect and will need open heart surgery in the future. I am just so stressed out and don't know what to do. Any advice?

i'm sure the judge would make allowances for a child with medical needs. so should your partner/husband. i haven't been through it myself though , maybe someone else can help?<img src="i/expressions/face-icon-small-smile.gif" border="0">

Hi Jennifer. Your ex is required to pay you child support. Typically, there is a worksheet that is used to determin the amount. If you are talking about spousal support, or alimony, I am not sure about that. What state are you in? I am a Paralegal, and just went thru a divorce myself.

I'm a lawyer of 25 years doing family law....I believe the judge would take into account your unique situation but you may need to educate him (thru your child's doctor) on the medical issues of your children.. best advice: get a good local family lawyer
