looking for your opinion

I was dx in March of this year, I am 27yrs old. I was recently let go from my job. three weeks prior to them letting me go I told them about my diagnosis. Their reason for letting me go was unjustified and was something that I feel they were digging for, they let me go for something that everyone did at the office and Im sure they are still doing. I am wondering if anyone has had a similar situation or if I should look into this deeper.
I appreciate your opinions I read the forum all of the time it has helped me with many questions and concerns.
Thank you, Kara

Kara,

I'm not much on law suits but I'd talk with a lawyer about wrongful dismissal. You didn't state the reason they gave you to terminate your employment but an attorney should be able to help you out. Reputable attorneys will be able to tell you over the phone if you have a case or not (free of charge) without dragging you into their office. Another option is to contact your states equal opportunity employment commission.

You might look into your states laws on dismissal. Texas employers need not have a reason to let someone go for example.

You might want to try to get Beth Sufian to comment - she's posted to this forum before about legal issues. She is an attorney in Houston who does a bunch of work for CF.

I would suggest contacting Beth Sufian too.

Also, you might want to shoot Julie a private message--she may have some insight to offer you too.

They have to give you a valid reason for your dismissal. Check out you local yellow pages for an employment attorney, a lot of times you can get a free consultation. I went to one when I was fired because someone else stole money from my store's till (LONG story). He was very informative and I could have sued the company because the unemployment department upheld my side of things, but I decided not to pursue it for personal reasons.

Are you willing to disclose to us what they let you go for? Surely there is a stigma on CF, however unfortunate and WRONG, it does exist. I'm not a lawyer, but i've done my share of fighting in courts over the years (and as strange as it is I love it!) and have learned quite a bit. However, I can't give any suggestions, guidance, help... nor can anyone else, if we don't know the generalities of what happened and why they are saying they let you go.

I'd love to help, but I need more info...

Well you've gotten some good advice here so far! If what youre saying is true, and there's no real reason for you to have been dismissed-it sounds like you got a case.
As i was reading it, I thought-'She HAS to call Beth Suffian", then I saw a few people posted that! She helped me with my disability payment case. She took an unfair bill I received-totally fabricated stuff-that was over 13,000 dollars and fought it. She fought social security and won!
She's in Texas, but I'm in NJ and she fought my case from there.

ug, no good! sounds awful. my advice to you is this: do what is best for your peace of mind. if you are able to let this go and move on, then do so. if you feel you cannot have peace until the matter is settled, then pursue it, but be prepared that it could be very emotionally draining. it sounds like what they did is probably illegal. that is another whole route to explore that could be hard for you; on the other hand it might be what you need to feel at peace with this.

good luck.

i say press the issue as much as you can with your boss [or ex boss lol] until they crack adn admit that they did it because of cf. i wish i did this with my previous boss. i just accepted her way out excuses that kept changing. later on i knew that if i kept asking her why she fired me she would have admitted it in the end because she was running out of excuses and ended up changing her final reason to "i dont have a reason".

I agree with Laura u do what is best for u. I mean if u go and sue the heck out of them it may last a long time and they will talk to as many people as they can to find something bad and they will use it against u. They will drag u through the mud and will not think twice about it. But if u dont feel u have got treated right and are willing to go through with it I would go for it. Good luck with ur choice

I think this was mentioned eariler but some states have an employ at will clause. Meaning you can be let go at anytime for any reason.

Kara -
I have been a legal assistant working for labor/employment defense attorneys for 8 years so I have some background with this kind of thing. First, as others have posted, we need a little more detail as to what happened. You say that you were doing something that everyone else in the office was doing . . . did you do something that violated a company policy? If so, then they had every right to terminate you for it despite the fact that others are/were doing it too. How long were you employed there? And did you have any prior discipline or performance issues?

It is true that you can contact the EEOC and file a complaint there. If they feel there is reason to investigate, they will. If your case there is dismissed, you can then proceed with a civil action in court. Be prepared to wait a long time to litigate if it gets to that point. We have cases that still have not gone to trial where the employee was terminated as much as 5 years ago. Truthfully, most cases don't even make it to trial.

You have to decide if it is really worth it to you to pursue this. If you honestly feel you were terminated due to having CF, by all means, contact the attorney others have referenced and see what she thinks. It is not as easy to win large settlements from companies as people think. There is a lot to go through to get to that point and, most importantly, there has to be merit to the claims being made.

Good luck and post again with more details if you can.
