Hello everyone, I wanted to get some opinions on a matter that I need help with. I am 27 years old and have ddf508. I started a new job in April 2012 at a 4 diamond hotel in 2012. The hotel was just opening and I was part of the team who opened the hotel. I got hired at the restaurant as a server. At first the hotel had no clue what they were doing. When I first got hired, they told us that we would be doing lunch and dinner shifts, which was perfect for me. When opening actually happened, they changed it to breakfast and dinner shifts. I started out working dinner shifts and everything was going great. Around Nov 2012, the owner decided to make the restaurant fine dining and they decided to finally train as on fine dining and how they wanted things to be done. Shortly after that I got dropped from my dinner shifts to breakfast alone. Keep in mind that breakfast starts at 630 am and I was having to be up at 445am in order to be there at 630. I went from 4-5 days a week to 2 days a week. I forgot to add that when I started I gave documents about my cf and told the manager that working the early morning was hard on me. After awhile of only working the 2 days a week, I talked to the manager that the 630 am shifts were really hard on me and that I would like to be put on nights but in order to be fair, I would work one breakfast shift a week at 8am. I ended u getting only one breakfast shift a week, and that's it. I have verbally told the manager that working the early morning is causing me to be run down and I'm afraid of getting sick and having to be put on IVs in the hospital. Nothing ever changed and I finally got fed up when another breakfast girl asked for a night shift and got it with ease. Keep in mind that I have never been late, never called out, never got a complaint from a customer, never been written up. When I would ask why my schedule is the way it is, the manager would reply that is what the owner of the company wants, and I am doing nothing wrong. I went to HR a couple days ago and told her about the incident. She aid that they an not give me nights because there are other servers that are a little stronger in fine dining and the owner wants them to work nights. She offered to transfer me to the bar where on weekends I would be working till 1am and it is very busy. I will be running around like a crazy person! I talked to a lawyer and he said what they are doing is night right. they need to make reasonable accommodations for me and transferring me to another department is not right. Do you all think I should go the legal route? I'm lost! I don't want to make a mess for myself but I feel like I have not been treated fair. They didn't try to help me at all.
