CF Help

Hey Guys,

As many of you know who read my blog I have been having really hard times with my health... and I just started a new job.....

I am really trying to find ways to more secure my job, because working right now seems almost impossible... (doing 14 hours a day IVs and also I just had the port put in on Thursday)

I am not saying I want to stop working I just want to find a way to be legally protected from being kicked off the special Baylor program I am on at my job if I need to miss a few days.

Currently, I work only Saturday and Sunday 11 am to 11 pm but I get paid for a full salary.. this has nothing to do with CF this is just a special program available to all nurses to apply for.

I live in South Carolina, and the rules seem to be a little different.. FMLA Is the same, I have to work for 1250 hours and be employed for at least one year... so being I have not hit the 90 day mark yet.. I don't qualify

THe lady in HR said once a year is up, that I should automatically sign up for FMLA and have it on record, so if I needed more days off, I can take them off one at a time under FMLA which I never heard of.. but that is so far away for me right now anyway..

Now as of Januray 19th which is next week.. I will have been on staff 90 days which qualifies me for full benefits, including paid time off, short term disability etc...

At my job, we are automatically put on Short term disability if we miss more then 3 scheduled days off in a row, so I would get paid a percent of my income and I would use time from my scheduled time off...only thing is I can be kicked out of the program if I miss more then 4 days a year of work..

Anyone know if and how ADA works in this case..? I need help... WOrking tomorrow with stiches is going to be almost impossible, yet I don't feel like I have a choice..

Also this is specifically to SC but for some reason, unless you are considered "home bound" meaning not work or drive, no one is entitled to at home nursing.. I can have my meds delivered but i have to go to the hospital or home infusion company to have blood drawn and dressings changed... It is so hard on me to drive myself around when my family isn't around and I can't keep relying on neigbors to take me..

Does anyone know anything about this, if I can hire private duty nurses and how I can get my insurance to pay for it? I would prefer not to pay out of pocket... I have two health insurances right now so I should be able to get something...

Anyone with any ideas????

I only know about home nursing. In all states you are only entitled to home care if you are home bound. Once upon a time that used to mean that you couldn't even leave your home for church services. It still means you can't go out to work or drive. The thought is that if you are well enough to get yourself to a job or to drive you are well enough to get yourself to medical care.

I am relieved for you that you are eligible for short term disability.

Ms Sufian also operates the CF Legal Information Hotline (1-800-622-0385) funded by a grant from Chiron Corporation. Individuals with CF and their families members and healthcare providers can contact the Hotline for information on the laws that protect people with CF and their families.

Follow Mel's advice, make that call and get advice from someone who knows how to deal with this effectively.

Your individual days off will be tracked (intermittent leave) and once you've been there a year, if you exceed 12 weeks a year of FMLA days your job won't be protected.
