im sueing Fed Ex

I have written about the loosing of my vest and of my clothes. Well its now been a month and a half and they still havent gotten any closer to finding it so i am just going to have to take them to court! I am not sure on what type of a lawyer i should get but after not having a good treatment (my mom beats on me and i use a vibrater too but it just doesnt do any good, well maybe a little but not enough...) I am gonna try to sue them for all they got!!! It is so Bulls**t that i have to sit here and suffer whi8le they dink around trying to find it! and since i moved for a little whle i have to change my tricare to over here i have to do that and then see a new dr and then have them put in for on! you know how long its gonna take to do that!! OMG I feel like going to fed ex and hitting people!!! haha!!! it wont help me out with the problem but maybe it would help me out mentally!!! ahaha!!!! anyways, my question was to you guys what type of a lawyer should i get and do you think i can get something out of it for having to suffer without a treatment for over a month and a half now!??!!! I am already in the 30% range on my pfts so it doesnt help that i cant get the crap out of my lungs! anyways, thanks again!

On behalf of everybody that has had problems with fedex and myself (don't get me started), I wish you luck.

My brother got a loaner vest from Seattle Childrens Hospital once, maybe Portland could loan you one. Its worth a shot.

Anyhoo, I don't know about what type of lawyer you should get, I've never sued anyone. But as far as getting pain and suffering benefits I'm sure you could. All you would need is medical records from before this happened showing what your PFTs were and what they are now. Also maybe a letter or testimony from a CF doc explaining why you need the treatments and what effect it has on you when you don't get them.

Oooh, that burns me up. I have had back luck with them too. They
once left a shipment of pulmozyme outside on the porch when the
package was CLEARLY labeled "MUST REFRIGERATE".<br>

Maybe Tom Hanks is using your vest on a remote island somewhere.

My advice is don't bother with suing, pain and suffering is so hard to prove you'd spend more money on the laywer than you would recieve from FedEx, if you were able to recieve anything at all.

If you still want another opinion, go to <a target=_blank class=ftalternatingbarlinklarge href="http://www.troubleshooter.com">www.troubleshooter.com</a>, where you can contact them and give you legal advice, but they're probably going to tell you the same thing. good luck

I know you are really frustrated right now and it would probably give you some satisfaction to take it out on FedEx but if I remember correctly wasn't it the Kinko's guy that screwed up? Those stores are independently owned so I would think that you'd have to sue the employee/store owner.

I think you'd be fighting an up hill battle as well since you didn't purchase the insurance.

I'm not trying to be a nay sayer here or get you down but I think your energy may be better spent on getting a loaner vest or speaking with Hill-Rom about possible solutions.

You may want to try your local media. Most have consumer watch dog groups and they may take an interest in you story.

Have you spoken with your insurance company about getting a new vest? Not sure how your insurance works but many have durable medical equipment coverage and if your "old" vest was paid for a while ago, they may be up for paying for a new one.

Thanks you guys! Yes it was fed ex kinkos but since that we have been working with fed ex they have re sent us that same box twice. My mom is dealing with this for me right now! She has talked to a lady about persueing legal actions and she (the lady that works for fed ex) is going to help us try to figure what we can do to take action cause she is totally stumbled too! I am wroking on asking tricare to get me a new vest but it might take as little while longer since i have to switch regions and then find a dr and then have him write in for it! So all in all, I will never give up on this fed ex kinkos thing.... they were totally stupid and for there stupidity, and lack of whatever it was... I am takeing them to court! Just the way they were not willing to help us out in the begining was redioulus. Not until they found out that they were the ones that made the mistake and it hadnt been lost in translation. (that is what the insurance is for) The box didnt even leave the store going to the right place. So its crap!!!!! anyways, thanks to all fo ryour opinions!

when i saw the title of this, i HAD TO RESPOND!!!!!
  Listen carefull!!!! i worked for federal express for 11
monts till i got fired for losing a package!!! i sh*T YOU
NOT!!!!!    TWO years ago, i was on my own
route and was called by dispatch to takeover a pickup route
because the courier had to go home on an emergency.. well, wouldn't
you know, one of the stops was bank of america,  out of all
places, and to make a long story short, the package never arrived
to it's destination. a 75 box, which of course they had me on
camera walkn out of the bank with, some how got lost, and guess who
got fired, ME!.. well, i knew i didn't steal that damn thing, and
basically the factors that got me terminated was they had
absolutely NO record of this thing... just to let you all know,
with fedex, everytime you pickup a package, there is a process,
scan the outgoing tag, then you hold your scanner up to the
handheld printer and it generates the shipping label to go out...
well, somehow, there was no scan for this paticular package so
trying to tell them i did scan it and process it, and there were
basically calling me a liar because on the scan report for that day
id did not show a scan for that stop... what a mess!!! i fought the
whole thing, but it was there word against mine, they even
interrigated me for nearly 4 hours and i even told them i woukd
take a lie detector test but they didn't want to hear it!!! MAN, I
GET MAD WHEN I THINK OF THAT AND IT HAS BEEN TWO YEARS...i was
making good money.... so who knows where it is, i could of left the
back of the door open and drove off and fell out, or it could be
lost in customs in some airport , the bottom line, sometimes weird
things happen and those scanners arent perfect, the airbill could
of been wrong and could of been shipped tp tim buck two, who knows,
but my suggestion to you would be to call the shipper, or fedwx

This really sucks. You would think a large company like this would have a better tracking system. I am sorry that you went thru this & I am sorry that Carianne is having her problems~

First thing you need to do is get the tracking#. Then go to their site (www.fedex.com) and track the package. That will show you where it was last scanned.
You also want to <u>file a claim </u>with Fedex. Ask them for a claim form. Once this is done they send it to their claims dept. and it is usually found within 24-48 hours. I work in this field (not for Fedex) and it is amazing what happens once you file a claim and they see the amount.
Then check if the shipper had it insured. If it is insured then you will be paid for the insured amount, otherwise it is so much $/lb, which is not usually much. If you are not sure then ask for a copy of the waybill.
If the merchandise was insured then you will get the value it was insured for. If it was no insured the courts will only give you the $/lb that is indicated on the bill. Don't spend $ on legal fees for a few bucks.

gosh this sounds really frustrating... the vest people just told me today that my vest is on the way and should be here by the end of the week via FedEx. i was surprised that no one has to be there to sign for it!

So i just got done talking to the insurance company and they called hill rom i think it was and they said that they would cover a vest for me to have again... so it will be the old version but oh well at this point i wil take anything! SO goood news on my part right now.. My mom wanted to jsut stop with the whole fed ex thing but i really dont think that we should just let this go. I am sick enough to go into the hospital righ tnow but i am holding off so i can go on a trip to cali since i already have my ticket!!! SO i think that since it has been two months or around there that they should have to have some punishment for this, they just cant get away with this with me! they are making me sicker by the day! but ok enough about that i get a new vest yeah!!!!

Instead of taking on fedex youself Cariann (because you'd be out a crapload of money unless you did the lawyer part yourself), contact your local news station. I know in WA and CA the news stations have some sort of "investigative" complaint section or "consumer awareness" department where they put stories like yours on the news and essentially BASH the company. You'd have to be willing to go publich with your CF for something like this, but if it can get you some money from fed ex.... I'd personally go for it.

Contact your local news stations, email and phone and don't stop sending them your story until they give you some of their time. That's one way to embarass Fexex to the point that they might pay a claim for you (even though you didn't insure it) and you might get some other compensation, or even find your lost package!

Just an idea, but unless you have gads of money or a lawyer willing to take the case for free, OR you know enough about the law to file for yourself in superior/federal court.... it's going to be loose/loose for you.
