Lost Job due to CF

Hi, I worked for an agency that really doesn't like people to be "sick" or have a diagnosis. I filled out FMLA papers for intermittent leave and disclosed that I have CF (i the section the dr signs). Little did I know there is a law that you do not have to disclose genetic information to employers called the GINA law <a href="http://www.eeoc.gov/laws/types/genetic.cfm">http://www.eeoc.gov/laws/types/genetic.cfm</a>). The employer has violated numerous sections of this law. Soon after turning in the FMLA papers I started being harrassed for bull. In the end they conjured up a story to get rid of me. I had 3 lawyers working with me on it. I decided not to fight it b/c it would take 5 years in court, $ and the stress would only make me sick. Soon, I lose my medical benefits. I have to buy my own medical insurance to the tune of $600+ per month.
Has this happened to anyone else?

Could you not file a complaint with the Attorney General in your state and have them fight it for you? I had an issue with Verizon and filed an complaint with the AG and a few weeks later i got a call from the Northeast Division manager and they worked out the problem immediately. I got a followup call from the AG's office also to make sure I was happy with the resolution.

Ive never been fired but def been questioned and screwed with for taking time. FMLA is supposed to protect your job but unfortunately it hurts us in the end because of disclosing your condition. Have you ever considered applying for disability? I am currently out on FMLA and going through the whole disability process. I applied for Medicaid and luckily recieved a letter approving me. I too will loose my insurance upon my resignation this month. At least look into your states Medicaid program. They have a "medically needy" coverage which is what I got. I would def look into legal action against your former employer.....what they did was illegal. Good luck.

LTA, I'm so sorry you have to go through something so stressful! I think there is a legal grant at the CF Foundation to help with this kind of stuff re: laws protecting your rights and applying for disability. I talked to a lawyer myself through the CF Foundaiton about seeing if I would qualify for disability. She was so very helpful and knowledgeable to talk with.
