Workplace Discrimination

I feel that I have been discriminated against both at my current job, and at a new place that I recently interviewed with, because I have to miss work because my daughter has CF. I believe that someone at my current school is telling any new, potential employers that I miss a lot of work. I found out from my reference that someone from the interview committee asked, "Is there anything in her personal life that would keep her from doing a good job?" My teaching contract allows me to miss 9 days per school year. I usually have to take all nine but have never had to ask for more. Is is illegal for your employer to tell someone you miss a lot of work when you are under your allotted days? Are there any advocacy groups out there that can help?

The FMLA only applies if the employer has 50 employees and only once you have worked more than 1250 hours for 12 months so when switching jobs it is a huge problem, although your state might have broader protections. Whether discriminating because of someone else's disability is illegal is a tricky and unclear question, but "attendance" is an essential function so depending on the amount of needed absences they might even be able to "legally" discriminate too. I'm sorry you are facing this. As Bill said call the CFF legal contact b/c she can find out what state you are in and get enough facts to help further.
