I was with you up until you decided to incorporate immigration into the issue. You're perpetuating the idea that those arriving into this country by "floating here on a raft" are capable of receiving SS benefits. Aside from monetary qualifications, being able to receive said benefits is contingent upon supplying multiple valid forms of identification--including a social security number. Of course, you can <i>try</i> to cheat the system via a false number, but trying to pull one over on the body that assigns SS numbers to people in the first place doesn't work very well.

Until you have adequate knowledge of the immigration system, or have nightmares of having your (legal) spouse ripped away from you and thrown out of the country, I suggest sparing us the Immigrant Blame Game.

Shortly after being denied benefits for the second time, I overheard a leech in the waiting room at my therapist's office. She was on her cell, I assume talking to a friend. <i>"Yeah, when I get my disability check, maybe we can go get our nails done!"</i> My guess was that she was a doper.

THEY are the people you should be angry with.

I wont get into the blaming or nit picking aspect. My Dad retired & died within 1 year of his retirement so he got some benefits, but not alot. I collected as a dependant survivor for 18 months after that & when my Mom turned 62 she collecdted as a widow.

I could be collecting under my Father still if my Mom would have followed through on the application when I was a child, BUT in doing that I wouldnt be the fantastic adult I am today. I learned a lot from my jobs & hardships that being an adult throws at you.

SS wasnt set up to handle an influx of disabled children. Hell it wasnt really meant to handle the influx of retirees. Until they change the guidelines many people will get screwed. If you work & have enough time & credits in then you are entitled to SSDI, but the dollar amount depends on what your history of earnings was.

SSI is based more on assets then work history. Either way (even as a retiree) you have a limit in which you can earn & collect SS. Even when filing income tax....SS is taxable depending on where you fall with your total combined income for the tax return.

I voluntarily have $$ withheld from my SS so when tax time comes I know I will get it back. We dont fall into the combined income level that we pay anything on my SS.

I know you are bitter. I know its not fair at times. Unfortunately for now...it is what we have. Care to take some action to turn it around? I will be behind you. I just dont have the energy to fight the system......

In the meantime contact Beth Sufian. She knows her stuff & if there is anyway to help you, she would know!!!!!!!!!!!!!!!

On an immigration issues, if a cuban steps one foot, guess for that matter even a toe, on American soil, we can not ship them back, they get to stay, this just happened recently. The whole immigration system is so screwed up. How can the govt deport a person's spouse, but a child born in american to an illegal immigrant is considered a citizen. That is why the next presidental canidate is so important. Someone needs to get a grasp on all the illegals that get the rewards of our system. If I take my child to the hosp and have no insurance, they are demanding payment and if not damaging my credit and threatening to sue....but if an ILLEGAL foriegner goes, they get free care????

BUT, to follow up on our system. I am really sorry for your father's passing and that he never got to collect what he paid in. BUT, facts are, if my father died the same way, I would not be able to collect anything from his, if I was over 18. Yes, because I am not disabled, but as we all know having CF alone does not make u disabled. And u have been working, so I believe SS does have a right to take your benifits away. Not to say u r not disabled now, but then if that is the case u should be able to get benefits off your earnings.

Basically, I guess being the conservative that I am, I believe it is not the government's responsiblity to take care of people. The SS system was not set up for that. Even though that is how it is existing today. It was your father's responsibility if he was making lots of money to set money aside, to see that his family is taken care of for a long time, examples: life insurance, 401K, etc......

And finally, your right u get rewarded for not working, but ask yourself this, could u have lived or live off a government check for $1,000 amonth. That really is not that much.......I like be able to go out into the workforce, and determine what my take home pay is going to be.

Shouldn't you be able to file for disability based on <i>your own </i>work history in a few years, providing you stay at the same job or even if you take another job, as long as you continue working?

Here is a link to the SSDI website that explains the criteria:
<a target=_blank class=ftalternatingbarlinklarge href="http://www.ssa.gov/retire2/credits3.htm">link</a>

And here is where it basically explains what work credits are:
<a target=_blank class=ftalternatingbarlinklarge href="http://www.socialsecurity.gov/pubs/10072.html">2nd Link</a>

I feel for you, that would suck that you may need to pay some or all back...who's got that kind of money?

Someone at SSI or SSDI should have been up-front with you & explained that it was double-dipping or having your cake & eating it too, (or whatever it's called) to work full time <b>plus </b>draw disability income--no matter who's disabilty you were drawing off of.
