ssi denial

Ok, so finally after months of waiting, Vincent is denied SSI because he is not disabled. I've know I should appeal, and that people are often denied on the first attempt. But, according to the paper they sent, I'm not sure he will be approved any time soon. This is what the letter says:

"Although Vincent's impairment results in some problems for him, the evidence we considered does not show that the condition causes marked and severe functional limitations. Therefore we cannot consider him disabled."

I know I can appeal and send in more info from his doctors or from his most recent hospital stay last month (most of them didn't bother to send in their reports, it says in the letter who did and did not, and I am so pi$$ed!), but should I bother? I'm not sure CF is causing severe functional limitations, he's only 19 mos. old, I do everything for him! I applied after receiving a call from human services asking if I had yet and saying he should be eligible. I know we make the financial requirements.

I've seen a lot of helpful posts on this site from people who know a lot about this kind of thing, so please give me some advice!

You can't fight City Hall but you can certaintly get an attorney to fight them for you. Has Seizure disorder and fetal alcohol syndrome.

Bottom line is I got out the yelow pages and found an attorney. You want one that specializes in SSI Disability, maybe even only SSI Disability (tha's the kind I got.). <span class="FTHighlightFont">They an't charge you unlessthey win the case and than the fee is subtracted from the lump sum benefit (back money) they owe you. Also, they can only get paid a certain percentage by law. This is the only way to go.

Thanks Dolline, I'm hoping I won't need a lawyer yet. I'm going to reapply and submit more reports from the doctors who didn't send them in. I'll hand deliver them myself if I need to. I can't believe after I talked to the docs/nurses about it and faxed them the forms that they didn't fill the forms out and send them in! Also, I applied for SSI, not SSDI, Vincent's not even two years old. But I'm not sure any amount of forms can convince them that he has severe functional limitations.

Does anyone here with young children receive SSI for their children? I assure you I do not intend to blow the money on myself. It really is needed.

Call your local attorneys that specialize in Disability. Most of them will not charge anything until you get approved for SSDI. Then they get 25% of the settlement (pay from the month you first applied until the month you are approved). The settlement can only go back one year though, so if you've battled this for 2 years you will only get 1 year of back pay.
This may actually be the law that they can't charge you unless you are approved so you shouldn't be out a penny unless you are approved.

She is out of Texas and takes cases all over the country. WIth no doubt you have to call her if you want to win otherwise, I feel your chances are slim to none. Please call her it is worth it!!!
