Call your local attorneys that specialize in Disability. Most of them will not charge anything until you get approved for SSDI. Then they get 25% of the settlement (pay from the month you first applied until the month you are approved). The settlement can only go back one year though, so if you've battled this for 2 years you will only get 1 year of back pay.
This may actually be the law that they can't charge you unless you are approved so you shouldn't be out a penny unless you are approved.</end quote></div>
Just wanted to clear up this info because this isn't 100% accurate and I don't want anyone to be out money for it. #1, a lawyer CAN NOT charge you any of the back pay unless you win, and then they do get 25% of the back pay (as stated above). However, if you loose OR win, they CAN and WILL charge you for incidentials like phone calls (long distance), faxes, mailing, copying.... So it's not 100% fee. We paid our lawyer $325 in addition to the back pay he recieved.
Additionally, Back pay goes as far back as from the date you applied... NOT only one year!!!! So if you applied 3 years ago and just finally won your case (with or without a lawyer, with our without a hearing), you are entitled to ALL that back pay, provided you appealed and did NOT reapply.
Amber, just wanted to let you know the CF qualifications for SSI/SSDI are the exact same, although the child impairments differ a bit from the adults (the FEV levels and such because they are based on height). Beth helps both adults and children, this much I do know so if you get to the lawyer point, she is THE BEST one out there!!!! The ONLY difference between SSI and SSDI are that SSI is for "low income" people and SSDI is based off of one's work history. And a child under 18 CAN qualify for SSDI, but they would qualify off of their parents or grandparents work history/Social security benefits. I'm not sure of how this would affect the parents/grandparents future or current Social security benefits. But if your child does qualify medically but you are "over income" for SSI, qualifying off of a parent/grandparent is always a consideration.
Hope this helps and I got your email and am happy to help, just let me know what info you have about vincent (I sent you some questions in the last email) and I'll do what I can to help you, see if you cant' get somewhere before hiring a lawyer. Sure they only get the back pay, but if you can pocket that yourself.... all the better. Just remember to APPEAL, APPEAL, APPEAL!!!!!!!!!!!!!!!!!!!
Just saw your last post amber, TOBI is a nebbed anti. so count that! how long ago was he on it? How many days (1 month, 2 months, every other month, one time montly use...).
What were the IV antibiotics for? (did he culture something, have a cold, running a fever???)
I'm going to email you some excel spread sheets and word documents as soon as I get my STUPID laptop to work. we decided to keep track of mark's lung infections and what he was given for them (nebulized tobi, which is an antibiotic), pill antibiotics, what he cultured. I recommend that you keep track of Vincents stuff this way too. That way you can hand it over to the SSA with your appeal. I'll send you what we used so you can get a layout idea, of course you can set up your own system but this might get you started. It might be a few days though because I can't even get the dumb laptop to turn on right now!
