I would definately send julie and email. My son is on ssdi. We were approved in less than six weeks. They consired that i was a lie threating illness. He was not diagnosed till he was 9 years old he is 13 now. I was lucky that all his doctors sent in the information requested. That was the longest part because he had so many doctors to contact if I am not mistaken their was atleast 6 doctors and four hospitals to contact. He has been sick ever since he was little but it took a lot of fighting and finally getting a good doctor to realize that getting pneuomoia contantly was not normal and reconized the sign and sent him to a cf accredited center to be tested. Gettin all the documentation from doctors is important and getting all the information about cf is important. Good luck and appeal appeal appeal.

Thanks everyone!

Julie- I am not aware of the requirements. I was hoping you'd respond, I know you have a lot of info on this. I will email you. Thanks so much! I know there's some info in Julie's corner, I'm going to go read it.

Jennifer- As for Beth Sufian, since she specializes in CF disability cases, and I'm applying for Supplemental Security Income (SSI) for Vincent, not disability (SSDI) I'm not sure she could help. I'll google her anyways. Thanks.

To anon at 8:48- They sent me info on appeals with the denial letter. It said there are groups or lawyers that can help with appeal, and a list available through my SS office. It also said if I hire someone to let them know, they have to approve the fee before they could collect it.

To anon at 10:34, I'm not exactly sure what the income requirements were here in CT, and they may be different in other states anyways, I'm not sure. I called my local social security office and told them I wanted to apply. They set me up with an appt. for a couple weeks later. First thing they did was see if I qualified income-wise before starting all the paperwork and everything else. Sorry, I wish I could remember what the income limit was. I think you could call your local SS office and ask though.

Kandi- I will definately appeal appeal appeal. I had 4 docs and 2 hospitals to get info from. Since the ss office didn't receive most of it, I'd like to try again. Maybe with all the info they'll rule differently. But I'm not sure any amount of paperwork will convince them he has a severe functional limitation.

So thanks for all the replies, very helpful! Keep them coming! Also, I'd really like to talk to a mom or dad who's young child receives SSI for CF, see what they did about the whole "severe functional limitations" thing.

I also wanted to answer Julie a little better about meds/hospitalizations etc.

First and foremost, I feel bad even asking for your help because you're probably so busy already! If its too much, don't worry about me.

I just thought I'd let you know:
-hospitalized 2x, once for 5 weeks, once for 10 days
-he's on lots of nebs, but no nebbed anti's. He has been on Tobi in the past
-he's currently on oral meds, and has been off and on for 3 months now. also has been in the past. just finished 2 wks. IV's.
-quite a few infections, but no pneumonia (PA, stenotrophomonas, always staph)
-pancreatic insufficient, no prob with weight gain up until this year. Did not gain even 1 lb. in over 3 months. even did a fecal fat test to see why.

maybe that'll give you some idea on where we're at.

Call your local attorneys that specialize in Disability. Most of them will not charge anything until you get approved for SSDI. Then they get 25% of the settlement (pay from the month you first applied until the month you are approved). The settlement can only go back one year though, so if you've battled this for 2 years you will only get 1 year of back pay.

This may actually be the law that they can't charge you unless you are approved so you shouldn't be out a penny unless you are approved.</end quote>

Just wanted to clear up this info because this isn't 100% accurate and I don't want anyone to be out money for it. #1, a lawyer CAN NOT charge you any of the back pay unless you win, and then they do get 25% of the back pay (as stated above). However, if you loose OR win, they CAN and WILL charge you for incidentials like phone calls (long distance), faxes, mailing, copying.... So it's not 100% fee. We paid our lawyer $325 in addition to the back pay he recieved.

Additionally, Back pay goes as far back as from the date you applied... NOT only one year!!!! So if you applied 3 years ago and just finally won your case (with or without a lawyer, with our without a hearing), you are entitled to ALL that back pay, provided you appealed and did NOT reapply.

Amber, just wanted to let you know the CF qualifications for SSI/SSDI are the exact same, although the child impairments differ a bit from the adults (the FEV levels and such because they are based on height). Beth helps both adults and children, this much I do know so if you get to the lawyer point, she is THE BEST one out there!!!! The ONLY difference between SSI and SSDI are that SSI is for "low income" people and SSDI is based off of one's work history. And a child under 18 CAN qualify for SSDI, but they would qualify off of their parents or grandparents work history/Social security benefits. I'm not sure of how this would affect the parents/grandparents future or current Social security benefits. But if your child does qualify medically but you are "over income" for SSI, qualifying off of a parent/grandparent is always a consideration.

Hope this helps and I got your email and am happy to help, just let me know what info you have about vincent (I sent you some questions in the last email) and I'll do what I can to help you, see if you cant' get somewhere before hiring a lawyer. Sure they only get the back pay, but if you can pocket that yourself.... all the better. Just remember to APPEAL, APPEAL, APPEAL!!!!!!!!!!!!!!!!!!!

Just saw your last post amber, TOBI is a nebbed anti. so count that! how long ago was he on it? How many days (1 month, 2 months, every other month, one time montly use...).
What were the IV antibiotics for? (did he culture something, have a cold, running a fever???)

I'm going to email you some excel spread sheets and word documents as soon as I get my STUPID laptop to work. we decided to keep track of mark's lung infections and what he was given for them (nebulized tobi, which is an antibiotic), pill antibiotics, what he cultured. I recommend that you keep track of Vincents stuff this way too. That way you can hand it over to the SSA with your appeal. I'll send you what we used so you can get a layout idea, of course you can set up your own system but this might get you started. It might be a few days though because I can't even get the dumb laptop to turn on right now!

Amber,
I would definitely give the CF attorney that was mentioned earlier
a call. As for attorneys that social security may provide for you,
I believe they are public defenders. I had a friend who used one in
a different kind of suit with Social Security Disability and it
didn't work out so well. As far as what disability type to file for
a good attorney would know that.

We paid our attorney nothing and we told SS that he was the
attorney. He handled gathering all the paperwork after we presented
him with what we had. My son's back payment was for 18 months
to 2 years. Also check SS web site about appeals and how much to
pay an attorney, etc. When they finally pay the claim they most
usually take out the attorney's portion and pay them directly.

Good luck and hang in there.

Thank you everyone!I need to take a better look at the requirements. I didn't even know I could get back pay! If I can get the doctors' offices to help me out with records and such, maybe I'll be ok without a lawyer. I'm going to go check my e-mail for the spread sheets. I could really use the clinic's help on those, I'm not positive about all the dates.

Julie, as far as the questions you asked in the email, I wasn't sure if you were telling me the questions I should get the answers to for the appeal, or actually wanted me to answer them for you so you can help. I don't want to cause you too much trouble, I know you've got you're hands full enough already. If you want me to actually send it to you let me know.

It's either or Amber, You could answer the questions for me, or just answer them for yourself , and "match" them up with the CF impairment listings for a child with CF. I'm more than happy to help, but I can understand if you don't want to disclose that information to a stranger, but if you wanted to answer the questions I sent in the email/posted on here (if you prefer to respond to them via email) I can better guide you. I'm no lawyer, but after all Mark and I went through (with a useless lawyer I might add), I pretty much won our case for him, our lawyer said one sentence at the hearing and that was to thank the judge for his time...... So I just share what I've learned along the way and experienced.

If you want to give me the ansers, I'm happy to help you. but if you just wanted to make a menal note of the questions I asked you and do you own research, that's completely understandable.

it will be a week or so at least before I can send you the speadsheets because I have to send off the stupid laptop to have it fixed because it won't turn on, or if it does turn on, it turns off if you move it a cm.... I think soem wires are looseso we are sending it in because it's still under warranty. But the word document and excel spreadsheet are on that computer and so I have no access to them right now so don't hold your breath waiting for them, it might be a while. If you don't get anything in about 2 weeks, PLEASE PLEASE email me (I might forget, but I do want to email them to you).

Hope this helps and let me know ifyou stumble upon any more questions while you are working on this stuff......
