ssi denial

It's either or Amber, You could answer the questions for me, or just answer them for yourself , and "match" them up with the CF impairment listings for a child with CF. I'm more than happy to help, but I can understand if you don't want to disclose that information to a stranger, but if you wanted to answer the questions I sent in the email/posted on here (if you prefer to respond to them via email) I can better guide you. I'm no lawyer, but after all Mark and I went through (with a useless lawyer I might add), I pretty much won our case for him, our lawyer said one sentence at the hearing and that was to thank the judge for his time...... So I just share what I've learned along the way and experienced.

If you want to give me the ansers, I'm happy to help you. but if you just wanted to make a menal note of the questions I asked you and do you own research, that's completely understandable.

it will be a week or so at least before I can send you the speadsheets because I have to send off the stupid laptop to have it fixed because it won't turn on, or if it does turn on, it turns off if you move it a cm.... I think soem wires are looseso we are sending it in because it's still under warranty. But the word document and excel spreadsheet are on that computer and so I have no access to them right now so don't hold your breath waiting for them, it might be a while. If you don't get anything in about 2 weeks, PLEASE PLEASE email me (I might forget, but I do want to email them to you).

I'm planning on calling Monday and telling them I want an appeal, and ask them to send me the paperwork again that they had me send to Vincent's doctors/hospitals last time. I guess I'll have to hand deliver them this time, and keep calling and nagging if they've sent them in yet. I'll have to get some records myself because I'm not positive on exact dates of all his infections, hospitalizations, nebbed meds, etc. I'm planning on bringing it up at Vincent's clinic appt. Oct 11, maybe the social worker can help.

No problem with waiting for the spread-sheets, don't stress yourself with my troubles. What I really don't want is a hearing, but with my luck it'll come to that. Affording a lawyer will be tough. Thanks for helping and I'll send you an e-mail. No rush though!

Sounds good, I sent you an email this Am. Definately get his records if you can, they should give you one copy for free (I can't remember if that's state specific or a new requirement under HIPPA) but DON'T tell them it's for the Social security case, because then they WILL charge you. Just tell them you are starting your own medical file at home for him (that's how we got all of Mark's records free of charge).

You don't have to pay a social security lawyer up front. They will take 25% of your back pay if Vincent wins, plus any "incidentals" but they don't collect those "incidental" charges until the case is won/lost. And in our situation, we had the lawyer hired for 17 months and ended up owing him a little over $300, not too bad for 17 months really. Plus he got 25% of Mark's backpay but that was taken right out of the check, we never had to deal with it, SSA did it for us.

SSA lawyers can ONLY do it for the back pay, plus any charges they directly incurr (have to show you phone records, have to document what pages were copied, faxed... if they are going to charge you for those things) and those charges are usually pretty minimal. Ours was in the higher mark because we moved to CA 1/2 way through our case but were still using a lawyer in WA so there were lots of long distance calls.

As far as a hearing, ours wasn't bad. Of course to each his own, but I found the hearing to be much much better than any of the appeal opportunities we were given. We got to explain his case, outline how he MET the CF impairment listings and handed the judge documents outlining this. I think the hearing is WHY we won....

I have contacted Beth Sufian, and we've sent a couple e-mails back and forth. You guys were right, she is amazing! She has suggested I send over Vincent's records (once I get them all from 2 cf clinics, 2 pediatricians, and 2 hospitals he was admitted to for cf related infections). She will review them and see if she thinks we have a case. She has explained all about the fees, and how/when they'll be collected if she feels she could win the case. If she doesn't think he qualifies and we decide not to fight SSI, I'm not sure if there will be a fee for just having her review the records.

Also, she mentioned CF Education Day in NYC on Oct 15th. She organized it and is a speaker, as well as many other guest speakers. She said it would be fun and should give me a lot of hope for Vincent's future. She will be speaking about SSI/SSDI as well, and offered to meet with me in person if I attend. Anyone else going? I would love to but have so much going on next week I'm not sure if I could make it, we'll see. (Four doc. appts. between me and my son, plus a broken down car that needs to be fixed ASAP!) I didn't receive an invitation from my cf center (she said I should have) so she will e-mail me one. If anyone wants I could e-mail it to you when I get it. I went to a cf conference once, you should go if you never have. It really does give you so much hope!
