They mailed me the pamphlet after I applied. I'm sure you can find that info on SSA.gov also. My letter of denial of SSI benefits states that he must have a medical condition that causes severe and marked functional limitations and that condition must last or be expected to last 12 months in a row or result in death. They also told me that although my son's CF causes him some problems, it's not considered marked and severe functional limitations. We're still fighting.

When I appealed the man I spoke to told me straight out that its because none of his doctors sent in reports or medical records, from CF clinic or hospitalizations, only his pediatrician who knows very little about his condition and really only sees him for routine visits/immunizations. So I gathered all his med records myself and sent them in. I'm also calling and badgering the clinic docs to send in their reports. If we get denied this time, I'm sending his records to Beth Sufian and she will review them and see if she thinks we have a case. If she does, she'll be our lawyer and fight with us.

I also wanted to add that my son's CF center has a social worker who told me to let her know if they deny us again and that there are people she can get to help us. So talk to your child's social worker through the CF center if they have one.

You know when i was in south florida the c.f social worker said those same words and i argued with her about what the pamplet said and i showed her and she still said he would not get it but i never listened much when people told me i would not be able to do the impossible and as it turned out i did successfully get isaiahs ssi. Of course i did all the foot work and read some law books too but i succeeded because there was no way i was able to work with him having c.f , the day care centers all had smokers in them and as we know c.f. kids can not be around smoke. So i was forced to quit my job because i would not allow him to be around people that where smokers. it was a major income crisis on my familys income and it took us from the time he was 2 months old to he was about 2 but we got all his back pay for 12,890.97 cents so it was worth everything we had to do. With that money i was able to have a prearranged prepayed funeral arrangement for him for when that day comes if it should come tomorrow or 20 yrs from now but the thing is i have peace of mind knowing it is taken care of. So fight is all i can suggest with the social security people until you win. Because c.f is a terminal disease and thats what automatically qualifies them for the ssi, them doctors just need to do their jobs send in them forms.......

See #6 on this page: <a target=_blank class=ftalternatingbarlinklarge href="http://www.cysticfibrosis.com/julies_corner.cfm">http://www.cysticfibrosis.com/julies_corner.cfm</a> it should give you some information to start with.

Contrary to popular belief, just because one has CF and CF is, in the "end" a terminal disease, does NOT mean that a person will automatically qualify for it. The SSA leaves that, "and will result in death" part of their requirements open to interpertation.

There are impairment listings for CF and a person (adult or child) MUST meet or equal at least one of those impairment listings.

Jaynababy, I got your email and will get some information to you today/tomorrow to try and help you out.
